سَأَلْتُهُ عَنْ رَجُلٍ حَلَفَ فِي قَطِيعَةِ رَحِمٍ فَقَالَ قَالَ رَسُولُ اللَّهِ ( صلى الله عليه وآله ) لَا نَذْرَ فِي مَعْصِيَةٍ وَ لَا يَمِينَ فِي قَطِيعَةِ رَحِمٍ قَالَ وَ سَأَلْتُهُ عَنْ رَجُلٍ أَحْلَفَهُ السُّلْطَانُ بِالطَّلَاقِ وَ غَيْرِ ذَلِكَ فَحَلَفَ قَالَ لَا جُنَاحَ عَلَيْهِ وَ سَأَلْتُهُ عَنْ رَجُلٍ يَخَافُ عَلَى مَالِهِ مِنَ السُّلْطَانِ فَيَحْلِفُ لِيَنْجُوَ بِهِ مِنْهُ قَالَ لَا جُنَاحَ عَلَيْهِ وَ سَأَلْتُهُ هَلْ يَحْلِفُ الرَّجُلُ عَلَى مَالِ أَخِيهِ كَمَا عَلَى مَالِهِ قَالَ نَعَمْ .

احمد بن محمد نے اسماعیل بن سعد الاشعری سے، انہوں نے ابو الحسن الرضا علیہ السلام سے روایت کی، فرمایا: میں نے ان سے ایک ایسے آدمی کے بارے میں پوچھا جس نے رشتہ داری توڑنے کی قسم کھائی۔ انہوں نے فرمایا: رسول اللہ صلی اللہ علیہ وآلہ نے فرمایا: 'گناہ میں نذر نہیں، اور رشتہ توڑنے میں قسم نہیں۔' انہوں نے کہا: اور میں نے ان سے ایک ایسے آدمی کے بارے میں پوچھا جسے سلطان نے طلاق اور اس کے علاوہ دوسری باتوں کی قسم دلائی، اور اس نے قسم کھائی۔ انہوں نے فرمایا: 'اس پر کوئی گناہ نہیں۔' اور میں نے ان سے ایک ایسے آدمی کے بارے میں پوچھا جو اپنے مال کو سلطان سے بچانے کے لیے قسم کھاتا ہے۔ انہوں نے فرمایا: 'اس پر کوئی گناہ نہیں۔' اور میں نے ان سے پوچھا: کیا آدمی اپنے بھائی کے مال پر بھی ویسے ہی قسم کھا سکتا ہے جیسے اپنے مال پر؟ انہوں نے فرمایا: 'ہاں۔'
Translation
Ahmad Bin Muhammad, from Ismail Bin Sa’ad Al Ashary, (It has been narrated) from Abu Al-Hassan Al-Reza<sup>asws</sup>, said, ‘I asked him<sup>asws</sup> about a man who swore regarding the cutting-off of a relationship, so he<sup>asws</sup> said: ‘Rasool-Allah<sup>saww</sup> said: ‘There is neither a vow regarding a disobedience, nor an oath regarding cutting-off of a relationship’. He (the narrator) said, ‘And I asked him<sup>asws</sup> about a man whom the Sultan (ruling authority) made to swear regarding a divorce and other than that, so he swore. He<sup>asws</sup> said: ‘There is no crime upon him’. And I asked him<sup>asws</sup> about a man who fears upon his wealth from the Sultan (ruling authority), so he swears in order to save by it, from him. He<sup>asws</sup> said: ‘There is no crime upon him’. And I asked him<sup>asws</sup>, ‘Should the man swear an oath upon the wealth of his brother just as he does upon his own wealth?’ He<sup>asws</sup> said: ‘Yes’.
