كَتَبْتُ إِلَيْهِ الْوَصِيُّ يُزَكِّي عَنِ الْيَتَامَى زَكَاةَ الْفِطْرَةِ إِذَا كَانَ لَهُمْ مَالٌ فَكَتَبَ لَا زَكَاةَ عَلَى يَتِيمٍ وَ عَنْ مَمْلُوكٍ يَمُوتُ مَوْلَاهُ وَ هُوَ عَنْهُ غَائِبٌ فِي بَلَدٍ آخَرَ وَ فِي يَدِهِ مَالٌ لِمَوْلَاهُ وَ يَحْضُرُ الْفِطْرُ أَ يُزَكِّي عَنْ نَفْسِهِ مِنْ مَالِ مَوْلَاهُ وَ قَدْ صَارَ لِلْيَتَامَى قَالَ نَعَمْ .
Translation
Muhammad Bin Al Husayn, from Muhammad Bin Al Qasim Bin Al Fuzayl Al Basry, (It has been narrated) from Abu Al-Hassan<sup>asws</sup>, said, ‘I wrote to him<sup>asws</sup>, ‘The executor of a will, can he purify from the orphans by the Zakat of Al-Fitra, when there was some wealth for them?’ So he<sup>asws</sup> wrote: ‘There is no zakat upon the orphans’. And about the slave whose master dies and is absent from him in another city, and in his hand is some wealth of his master, and the (payment of the) Fitra presents itself, can he purify from himself, from the wealth of his master, and it has already gone to the orphans?’ He<sup>asws</sup> said: ‘Yes’.
