John Shaqi

رَجُلٍ وَجَبَ عَلَيْهِ حَدٌّ فَلَمْ يُضْرَبْ حَتَّى خُولِطَ فَقَالَ "إِنْ كَانَ أَوْجَبَ عَلَى نَفْسِهِ اَلْحَدَّ وَ هُوَ صَحِيحٌ لاَ عِلَّةَ بِهِ مِنْ ذَهَابِ عَقْلٍ أُقِيمَ عَلَيْهِ اَلْحَدُّ كَائِناً مَا كَانَ".


اردو

الْحَسَن بْن مَحْبُوب نے عَلِي بْن رِئَاب سے روایت کی، جو أَبُو عُبَيْدَة سے، جو أَبُو جَعْفَر علیہ السلام سے روایت کرتے ہیں: ایک شخص کے بارے میں جس پر حد کا حکم واجب ہوا، لیکن اس پر حد نہیں لگائی گئی یہاں تک کہ وہ ذہنی طور پر پریشان ہو گیا، تو اس نے کہا: اگر اس نے حد کو اپنی ذات پر اس وقت واجب کر لیا تھا جب وہ صحیح تھا اور اس کے عقل کے جانے کی کوئی بیماری نہیں تھی، تو حد اس پر نافذ کی جائے گی، چاہے جو بھی صورت ہو۔


Translation

Hadith.5046 - In the narration reported by Al-Hasan ibn Mahbub from Ali ibn Riʾab from Abu Ubaydah from Abu Jafar (as), regarding a man upon whom a legal punishment (hadd) was due but he was not punished until he became mentally disturbed. Imam (as) said: "If he had confessed to the hadd upon himself while he was sound in mind and free from any mental illness, then the hadd must be carried out on him regardless of his current state."
