الْحَسَن بْن مَحْبُوب نے عبد اللہ بْن سِنَان اور ابن بُکَیر سے روایت کی، جو ابو عبد اللہ علیہ السلام سے روایت کرتے ہیں، جنہوں نے فرمایا: ان سے پوچھا گیا کہ ایک مؤمن جو جان بوجھ کر دوسرے مؤمن کو قتل کرتا ہے، کیا اس کے لیے توبہ ہے؟ تو انہوں نے فرمایا: اگر اس نے اسے اس کے ایمان کی وجہ سے قتل کیا تو اس کے لیے کوئی توبہ نہیں۔ لیکن اگر اس نے اسے غصے یا دنیاوی کسی وجہ سے قتل کیا تو اس کی توبہ یہ ہے کہ اس سے قصاص لیا جائے۔ اگر کسی کو اس کا علم نہ ہو تو اسے مقتول کے وارثوں کے پاس جانا چاہیے اور ان کے سامنے اعتراف کرنا چاہیے کہ اس نے ان کے ساتھی کو قتل کیا ہے۔ اگر وہ اس کو معاف کر دیں اور قتل نہ کریں تو اسے ان کو دیت دینی چاہیے، ایک غلام آزاد کرنا چاہیے، مسلسل دو مہینے روزے رکھنا چاہیے، اور ساٹھ مسکینوں کو کھانا کھلانا چاہیے تاکہ اللہ عزّوجلّ کی طرف توبہ ہو۔

Translation

Hadith.5164 - Al-Hasan ibn Mahbub narrated from Abdullah ibn Sinan and Ibn Bukayr from Abu Abdullah (as), who was asked about a believer who intentionally kills another believer - does he have repentance? Imam (as) said: "If he killed him because of his faith, then there is no repentance for him. But if he killed him out of anger or due to some worldly reason, then his repentance is that retribution be taken from him. If no one knows about it, he should go to the family of the murdered person and confess to them that he killed their relative. If they forgive him and do not kill him, he must give them the blood money (diyyah), free a slave, fast for two consecutive months, and feed sixty needy people as repentance to Allah (swt), the Almighty and Majestic."
