: سَأَلْتُ أَبَا عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ عَنْ رَجُلٍ قُتِلَ وَ لَهُ أَبٌ وَ أُمٌّ وَ اِبْنٌ فَقَالَ اَلاِبْنُ أَنَا أُرِيدُ أَنْ أَقْتُلَ قَاتِلَ أَبِي وَ قَالَ اَلْآخَرُ أَنَا أَعْفُو وَ قَالَ اَلْآخَرُ أَنَا أُرِيدُ أَنْ آخُذَ اَلدِّيَةَ قَالَ "فَلْيُعْطِ اَلاِبْنُ أُمَّ اَلْمَقْتُولِ اَلسُّدُسَ مِنَ اَلدِّيَةِ وَ يُعْطِي وَرَثَةَ اَلْقَاتِلِ اَلسُّدُسَ مِنَ اَلدِّيَةِ حَقَّ اَلْأَبِ اَلَّذِي عَفَا وَ يَقْتُلُهُ".

الْحَسَن بْن مَحْبُوب نے ابو ولاد الحنّاط سے روایت کی، جنہوں نے کہا: میں نے ابو عبداللہ علیہ السلام سے ایک ایسے شخص کے بارے میں پوچھا جو قتل ہو گیا تھا اور اس کے والد، والدہ اور بیٹا تھے۔ بیٹے نے کہا، "میں اپنے والد کے قاتل کو قتل کرنا چاہتا ہوں،" اور دوسرے نے کہا، "میں معاف کرتا ہوں،" اور تیسرے نے کہا، "میں دیہ لینا چاہتا ہوں۔" انہوں نے علیہ السلام فرمایا: "پھر بیٹے کو چاہیے کہ مقتول کی ماں کو دیہ کا چھٹا حصہ دے، اور قاتل کے وارثوں کو دیہ کا چھٹا حصہ دے جو اس باپ کا حق ہے جس نے معافی دی اور پھر قاتل کو قتل کرے۔"
Translation
Hadith.5306 - Al-Hasan ibn Mahbub narrated from Abu Walad Al-Hannat that he asked Abu Abdullah (as) about a man who was killed and had a father, a mother, and a son. The son said: "I want to kill the murderer of my father," the mother said: "I forgive," and the father said: "I want to take the blood money (diyyah)." Imam (as) replied: "The son should give the mother of the murdered man one-sixth of the blood money and give the heirs of the murderer one-sixth of the blood money in the right of the father who forgave, and then he may kill the murderer."
