5307 - الحسن ابن محبوب نے ابو ولاد سے روایت کی، جنہوں نے کہا: میں نے ابو عبداللہ علیہ السلام سے ایک ایسے شخص کے بارے میں پوچھا جو قتل ہو گیا تھا اور اس کے چھوٹے اور بڑے بچے تھے۔ میں نے کہا: اگر اس کے بڑے بچے معاف کر دیں تو آپ کیا سمجھتے ہیں؟ انہوں نے علیہ السلام فرمایا: "اسے قتل نہیں کیا جائے گا، اور بڑوں کی معافی ان کے حصص کے بارے میں جائز ہے۔ پھر جب چھوٹے بچے بڑے ہو جائیں گے، تو ان کے لیے حق ہوگا کہ وہ دیہ کی اپنی حصہ طلب کریں۔" اور یہ بھی روایت کیا گیا ہے: "اگر وارثوں میں سے کوئی خون کے بارے میں معافی دے دے تو قصاص رفع ہو جاتا ہے۔"

Translation

Hadith.5307 - Al-Hasan ibn Mahbub narrated from Abu Walad who said: I asked Abu Abdullah (as) about a man who was killed and had both young and adult children. I asked: "What if his adult children forgave (the murderer)?" Imam (as) replied: "The murderer will not be killed, and the forgiveness of the adults is valid concerning their shares. When the younger children reach adulthood, they have the right to claim their share of the blood money (diyyah)." It has also been narrated: "If one of the heirs forgives regarding the blood, the retribution (qisas) is nullified."
