العلاء نے محمد الحلبي سے روایت کی، جنہوں نے کہا: میں نے ابو عبداللہ علیہ السلام سے اس شخص کے بارے میں پوچھا جس نے دوسرے شخص کے سر پر کلہاڑی مار کر اس کی آنکھیں گالوں پر بہنے لگیں۔ پھر زخمی شخص نے اپنے حملہ آور پر حملہ کیا اور اسے قتل کر دیا۔ تو ابو عبداللہ علیہ السلام نے فرمایا: "یہ دونوں ہی مجرم ہیں۔ میں اس شخص پر قصاص نہیں دیکھتا جس نے اس شخص کو مارا کیونکہ اس نے اسے اس وقت مارا جب وہ اندھا تھا، اور اندھے کی جرم کو غلطی سمجھا جاتا ہے۔ اس کی عقلہ ذمہ دار ہے؛ انہیں تین سال میں ہر سال قسط میں ادا کرنا پڑتی ہے۔ اگر اندھے کے پاس عقلہ نہ ہو تو اس کے کیے ہوئے جرم کی دیہ اس کے مال سے تین سال میں لی جاتی ہے۔ اور اندھا اپنے آنکھوں کی دیہ کے لیے اس کے وارثوں سے رجوع کر سکتا ہے۔"

Translation

Hadith.5313 - Al-Alaʾ narrated from Muhammad Al-Halabi who said: I asked Abu Abdullah (as) about a man who struck another man's head with a pickaxe, causing his eyes to fall onto his cheeks. The injured man then attacked his assailant and killed him. Abu Abdullah (as) said: "Both of them were aggressors. Therefore, I do not see that the one who killed the man should face retaliation because he killed him while he was blind, and the crime of a blind person is considered a mistake. His blood money (diyyah) is the responsibility of his Aqilah (male relatives responsible for blood money), to be paid over three years, with one-third paid each year. If the blind man has no Aqilah, the compensation must be paid from his own wealth over three years. Moreover, the blind man has the right to claim the blood money for his eyes from the heirs of his attacker."
