اگر کوئی مرد اپنی بیوی اور پوتے پوتیاں چھوڑ جائے تو بیوی کو آٹھواں حصہ ملتا ہے اور جو کچھ باقی رہ جائے وہ پوتے پوتیوں کا ہوتا ہے۔ اگر کوئی عورت اپنے شوہر اور پوتے پوتیاں چھوڑ جائے تو شوہر کو چوتھائی حصہ ملتا ہے اور جو کچھ باقی رہ جائے وہ پوتے پوتیوں کا ہوتا ہے۔ اس کی وجہ یہ ہے کہ شوہر اور بیوی دو بنیادی وارث نہیں ہیں؛ بلکہ وہ سبب کی وجہ سے وارث ہوتے ہیں، نسب کی وجہ سے نہیں۔ اس لیے پوتے پوتیاں ان کے ساتھ بچے کی جگہ لیتے ہیں کیونکہ مرنے والے کے نہ بچے ہیں اور نہ والدین۔

Translation

"If a man dies and leaves behind a wife and grandchildren (descendants of his children), the wife receives one-eighth of the inheritance, and the remainder goes to the grandchildren. If a woman dies and leaves behind her husband and grandchildren, the husband receives one-fourth of the inheritance, and the remainder goes to the grandchildren. This division is because the husband and wife are not considered primary heirs by blood; rather, they inherit through marital relation, not through lineage. Therefore, the grandchildren take the position of the direct children when there are no surviving children or parents of the deceased."
