اور حَمّاد نے الحلبی سے روایت کی، جو ابو عبداللہ علیہ السلام سے روایت کرتے ہیں، جنہوں نے فرمایا: میں نے ان سے اس مَلْعَنَة کے بارے میں پوچھا جس میں شوہر اپنی بیوی پر الزام لگاتا ہے، اپنے بچے کو منکر ہوتا ہے، اور اس کے ساتھ لِعان کرتا ہے، پھر بعد میں شوہر کہتا ہے، 'بچہ میرا بچہ ہے'، اور خود کو جھوٹا قرار دیتا ہے۔ انہوں نے فرمایا: 'جہاں تک عورت کا تعلق ہے، وہ کبھی بھی اس کے پاس واپس نہیں جاتی۔ جہاں تک بچے کا تعلق ہے، اگر وہ اسے قبول کرے تو میں اسے واپس اس کے حوالے کر دیتا ہوں، اور میں اس کے بچے کو وراثت سے محروم نہیں کرتا۔ بیٹا والد سے وارثت پاتا ہے، لیکن والد بیٹے سے نہیں پاتا۔ اس کی وراثت اس کے ماموں بھائیوں کو جاتی ہے۔ اور اگر کوئی اسے زنا کے بچے کہے تو اسے حد کی سزا دی جاتی ہے۔'

Translation

Hadith.5691 - Hammad narrated from Al-Halabi, from Abu Abdullah (as), who was asked about a case of mula'anah (mutual cursing) where a man accuses his wife of adultery, disowns her child, and they engage in the process of mula'anah. Later, the husband claims that the child is indeed his and denies his earlier accusation. Abu Abdullah (as) said: "As for the woman, she can never return to him. As for the child, I return the child to him if he acknowledges it, and I will not leave his child without inheritance. The son inherits from the father, but the father does not inherit from the son. The child's inheritance goes to his maternal uncles. However, if anyone claims a child of adultery (walad Al-zina), he will be subjected to the prescribed punishment (hadd) for false accusation."
