الْحَسَن بْن مَحْبُوب نے سَیف بْن عَمِیرَہ سے روایت کی، جو ابو بکر الحضرمی سے، جو ابو عبد اللہ علیہ السلام سے روایت کرتے ہیں، جنہوں نے فرمایا: اگر کوئی مسلمان مرد اسلام سے مرتد ہو جائے تو اس کی بیوی اس سے جدا ہو جاتی ہے جیسے تین طلاق کے بعد عورت جدا ہوتی ہے اور وہ اس سے عدت رکھتی ہے جیسے طلاق یافتہ عورت رکھتی ہے۔ اگر وہ اسلام پر واپس آ کر توبہ کر لے اس سے پہلے کہ وہ کسی سے نکاح کرے تو وہ صرف اس کا خواستگار ہوتا ہے اور اس پر اس کی عدت نہیں ہوتی بلکہ اس کی عدت دوسرے کے لیے ہوتی ہے۔ اگر وہ عدت پوری ہونے سے پہلے قتل ہو جائے یا فوت ہو جائے تو وہ اس سے عدت رکھتی ہے جیسے شوہر فوت ہونے پر عورت رکھتی ہے، اس لیے وہ عدت کے دوران اس سے وارثت پاتی ہے لیکن اگر وہ مرتد ہو کر فوت ہو جائے تو وہ اس سے وارثت نہیں پاتی۔

Translation

Hadith.5713 - Al-Hasan ibn Mahbub narrated from Sayf ibn Umayrah from Abu Bakr Al-Hadrami from Abu Abdullah (as) who said: "If a Muslim man apostatizes from Islam, his wife becomes separated from him just as a woman becomes separated after a third divorce, and she must observe the waiting period (iddah) as a divorced woman does. If he returns to Islam and repents before she marries another man, he may propose to her again, and she is not required to observe any waiting period for him, though she must observe it for anyone else. However, if he is killed or dies before the completion of her waiting period, she must observe the waiting period of a widow (iddah of a deceased husband), and during that period, she inherits from him. But if she dies while he is still an apostate, he does not inherit from her."
