الْحَسَن بْن مَحْبُوب نے وَہْب بْن عَبْد رَبِّہ سے روایت کی، جو ابو عبداللہ علیہ السلام سے روایت کرتے ہیں، جنہوں نے فرمایا: میں نے ان سے ایک ایسے شخص کے بارے میں پوچھا جس کی ایک اُم ولد تھی، اور اس کا بچہ اس سے فوت ہو گیا۔ پھر اس نے اُسے دوسرے شخص سے شادی کر دی، اور اس نے اس سے بچہ پیدا کیا۔ پھر وہ شخص فوت ہو گیا، اور وہ اپنی مالک کے پاس واپس آ گئی۔ کیا اس کا حق ہے کہ وہ اس سے نکاح کیے بغیر اس کے ساتھ مباشرت کرے؟ انہوں نے فرمایا: وہ اس کے ساتھ مباشرت نہیں کرے گا جب تک کہ وہ مردِ وفات شدہ کے لیے چار مہینے اور دس دن کی عدت پوری نہ کر لے۔ پھر وہ بغیر نکاح کے ملکیت کی حیثیت سے اس کے ساتھ مباشرت کر سکتا ہے۔ میں نے کہا: اس کے شوہر کے بچے کا کیا؟ انہوں نے فرمایا: اگر اس نے مال چھوڑا ہے تو بچے کو اس کی قیمت پر خریدا جائے گا، پھر آزاد کیا جائے گا اور وارث بنایا جائے گا۔ میں نے کہا: اگر اس نے کوئی مال نہ چھوڑا؟ انہوں نے کہا: تو بچہ اپنی ماں کے ساتھ اسی حالت میں رہتا ہے۔

Translation

Hadith.5736 - Al-Hasan ibn Mahbub narrated from Wahb ibn Abd Rabbih from Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as) who said: I asked him about a man who had a slave woman (umm walad) and her child from him died. He then married her to another man, and she bore him a child. Later, that man died, and she returned to her original master. I asked: "Does he have the right to be intimate with her before marrying her?" Imam (as) said: "He cannot be intimate with her until she completes the waiting period (iddah) for the deceased husband, which is four months and ten days. After that, he may be intimate with her through ownership without marriage." I asked: "What about her child from the husband?" Imam (as) said: "If the deceased husband left wealth, the child should be bought for its value and then freed, and the child would inherit. If he left no wealth, the child remains with its mother in the same condition."
