حُرٌّ فَقُلْتُ وَ الْحُرُّ يَتَزَوَّجُ الْمَمْلُوكَةَ قَالَ يُلْحَقُ الْوَلَدُ بِالْحُرِّيَّةِ حَيْثُ كَانَتْ إِنْ كَانَتِ الْأُمُّ حُرَّةً أُعْتِقَ بِأُمِّهِ وَ إِنْ كَانَ الْأَبُ حُرّاً أُعْتِقَ بِأَبِيهِ .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Muhammad Bin Ismail, from Abu Ismail, from Abu Al Fazl Al Makfouf, author of Al Arabiyya, from Abu Ja’far Al Ahowl Al Taaqy, from a man, (It has been narrated) from Abu Abdullah<sup>asws</sup> having been asked about the owned slave who marries a free woman, what would be the state of the child? So he<sup>asws</sup> said: ‘Free’. So I said, ‘And the free man who marries the slave woman?’ He<sup>asws</sup> said: ‘The child would be attached with the free one wherever it (the freedom) may be. If the mother was free, so he would be free with his mother, and if the father was free, so he would be free with his father’.
