سَأَلْتُهُ عَنْ رَجُلٍ قَالَ إِنْ تَزَوَّجْتُ فُلَانَةَ فَهِيَ طَالِقٌ وَ إِنِ اشْتَرَيْتُ فُلَاناً فَهُوَ حُرٌّ وَ إِنِ اشْتَرَيْتُ هَذَا الثَّوْبَ فَهُوَ لِلْمَسَاكِينِ فَقَالَ لَيْسَ بِشَيْءٍ لَا يُطَلِّقُ إِلَّا مَا يَمْلِكُ وَ لَا يَتَصَدَّقُ إِلَّا بِمَا يَمْلِكُ .

میں نے ان سے ایک ایسے شخص کے بارے میں پوچھا جس نے کہا: 'اگر میں نے فلاں عورت سے نکاح کیا تو وہ طلاق یافتہ ہے، اور اگر میں نے فلاں (غلام) کو خریدا تو وہ آزاد ہے، اور اگر میں نے یہ کپڑا خریدا تو وہ مساکین کے لیے ہے'۔ تو انہوں نے فرمایا: 'یہ کچھ بھی نہیں ہے۔ کوئی اس چیز کو طلاق نہیں دے سکتا جس کا وہ مالک نہ ہو، اور نہ اس چیز کا صدقہ دے سکتا ہے جس کا وہ مالک نہ ہو'۔
Translation
Ali Bin Ibrahim, from his father, from Ibn Abu Najran, from Aasim Bin Humeyd, from Muhammad Bin Qays, (It has been narrated) Abu Ja’far<sup>asws</sup>, said, ‘I asked him<sup>asws</sup> about a man who said, ‘I shall marry so and so woman, so she is divorced, and I shall buy so and so (slave) so he is free, and if I were to buy this cloth, so it is for the poor’. So he<sup>asws</sup> said: ‘It is not with anything. There is neither a divorce except what he owns, not a charity except with what he owns’.
