كَتَبْتُ إِلَيْهِ يَعْنِي الرِّضَا ( عليه السلام ) أَسْأَلُهُ عَنِ الْفُقَّاعِ قَالَ فَكَتَبَ حَرَامٌ وَ هُوَ خَمْرٌ وَ مَنْ شَرِبَهُ كَانَ بِمَنْزِلَةِ شَارِبِ الْخَمْرِ قَالَ وَ قَالَ أَبُو الْحَسَنِ الْأَخِيرُ ( عليه السلام ) لَوْ أَنَّ الدَّارَ دَارِي لَقَتَلْتُ بَائِعَهُ وَ لَجَلَدْتُ شَارِبَهُ وَ قَالَ أَبُو الْحَسَنِ الْأَخِيرُ ( عليه السلام ) حَدُّهُ حَدُّ شَارِبِ الْخَمْرِ وَ قَالَ ( عليه السلام ) هِيَ خُمَيْرَةٌ اسْتَصْغَرَهَا النَّاسُ .
Translation
Muhammad Bin Yahya, from Muhammad Bin Ahmad, from Muhammad Bin Isa, from Al Washa who said, ‘I wrote to him<sup>asws</sup>, meaning Al-Reza<sup>asws</sup>, asking him<sup>asws</sup> about the fermented drinks. So he<sup>asws</sup> wrote: ‘It is prohibited and it is wine, and the one who drinks it would be at the status of the wine drinker’. He (the narrator) said, ‘And Abu Al-Hassan<sup>asws</sup> the Last said: ‘If the house was my<sup>asws</sup> house, I<sup>asws</sup> would have killed its seller, and would have whipped its drinker’. And Abu Al-Hassan<sup>asws</sup> the Last said: ‘Its legal penalty (<span class="iTxt">Hadd</span>) is a legal penalty (<span class="iTxt">Hadd</span>) of the wine drinker’. And he<sup>asws</sup> said: ‘It is a wine which the people are considering it as trivial’.
