سَأَلْتُهُ هَلْ تَجُوزُ شَهَادَةُ أَهْلِ مِلَّةٍ مِنْ غَيْرِ أَهْلِ مِلَّتِهِمْ قَالَ نَعَمْ إِذَا لَمْ يُوجَدْ مِنْ أَهْلِ مِلَّتِهِمْ جَازَتْ شَهَادَةُ غَيْرِهِمْ إِنَّهُ لَا يَصْلُحُ ذَهَابُ حَقِّ أَحَدٍ .

علی بن ابراہیم نے اپنے والد سے، انہوں نے ابن ابی عمیر سے، انہوں نے حماد سے، انہوں نے الحلبی اور محمد بن مسلم سے، انہوں نے ابو عبد اللہ علیہ السلام سے روایت کی کہ آپ نے فرمایا: میں نے ان سے پوچھا: کیا ایک ملت کے لوگوں کی گواہی ان کی اپنی ملت کے علاوہ کے لیے جائز ہے؟ انہوں نے فرمایا: ہاں، جب ان کی اپنی ملت کے لوگ نہ ملیں تو دوسروں کی گواہی جائز ہے۔ بے شک کسی کا حق ضائع ہونا مناسب نہیں ہے۔
Translation
Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hamaad, from Al Halby and Muhammad Bin Muslim, (The narrator says) ‘I asked Abu Abdullah<sup>asws</sup>, ‘Is the witnessing of the people of the nation (Muslims) allowed, from other than the people of their nation (Non-Muslims)?’ He<sup>asws</sup> said: ‘Yes, when they cannot find from the people of their own nation, the witnessing of the others is allowed. It is not correct for anyone’s right to go away (be wasted)’.
