الرَّجُلِ يُعْطِي الشَّيْءَ مِنْ مَالِهِ فِي مَرَضِهِ فَقَالَ إِذَا أَبَانَ فِيهِ فَهُوَ جَائِزٌ وَ إِنْ أَوْصَى بِهِ فَهُوَ مِنَ الثُّلُثِ .

محمد بن اسماعیل نے فضل بن شاذان سے اور ابو علی الاشعری نے محمد بن عبد الجبار سے، دونوں نے مل کر صفوان سے، مرازم سے، ہمارے بعض اصحاب سے، ابو عبداللہ علیہ السلام سے روایت کی اس شخص کے بارے میں جو بیماری میں اپنے مال سے کچھ دیتا ہے۔ تو آپ نے فرمایا: 'اگر اس نے اسے الگ کر دیا ہو، تو یہ جائز ہے، اور اگر اس نے وصیت کی ہو، تو یہ ثلث میں سے ہوگا۔'
Translation
Muhammad Bin Ismail, from Al Fazal Bin Shazaan and Abu Ali Al Ash’ary, from Muhammad Bin Abdul Jabbar both together, from Safwan, from Marazim, from one of our companions, (It has been narrated) from Abu Abdullah<sup>asws</sup> regarding the man who gave something from his wealth during his illness. So he<sup>asws</sup> said: ‘If he has kept it aside, so it is allowed (to use it), and if he has bequeathed with it, so it is from the third (to be given out)’.
