سَأَلْتُهُ عَنِ الْمُحَارِبِ فَقُلْتُ لَهُ إِنَّ أَصْحَابَنَا يَقُولُونَ إِنَّ الْإِمَامَ مُخَيَّرٌ فِيهِ إِنْ شَاءَ قَطَعَ وَ إِنْ شَاءَ صَلَبَ وَ إِنْ شَاءَ قَتَلَ فَقَالَ لَا إِنَّ هَذِهِ أَشْيَاءُ مَحْدُودَةٌ فِي كِتَابِ اللَّهِ عَزَّ وَ جَلَّ فَإِذَا مَا هُوَ قَتَلَ وَ أَخَذَ قُتِلَ وَ صُلِبَ وَ إِذَا قَتَلَ وَ لَمْ يَأْخُذْ قُتِلَ وَ إِذَا أَخَذَ وَ لَمْ يَقْتُلْ قُطِعَ وَ إِذَا هُوَ فَرَّ وَ لَمْ يُقْدَرْ عَلَيْهِ ثُمَّ أُخِذَ قُطِعَ إِلَّا أَنْ يَتُوبَ فَإِنْ تَابَ لَمْ يُقْطَعْ .
Translation
A number of our companions, from Sahl Bin Ziyad, from Ahmad Bin Muhammad Bin Abu Nasr, from Dawood Al Tai’y, from a man from our companions, (The narrator) says, ‘I asked Abu Abdullah<sup>asws</sup> about the combatant, so I said to him<sup>asws</sup>, ‘Our companions are saying that the Imam<sup>asws</sup> has a choice in it, if he<sup>asws</sup> so desires to he<sup>asws</sup> cuts, and if he<sup>asws</sup> so desires to he<sup>asws</sup> crucifies, and if he<sup>asws</sup> so desires to, he<sup>asws</sup> kills’. So he<sup>asws</sup> said: ‘No! These things are Limited in the Book of Allah<sup>azwj</sup> Mighty and Majestic. So if it is such that he has killed and seized (property, he would be killed and crucified; and when he has killed and die not seize (property), he would be killed; and when he seizes (property) and doe not kill, so he would be cut; and when he flees and is not able to be caught, then he is seized, he would be cut, except if he were to repent. So if he were to repent, he would not be cut’.
