سُئِلَ عَنِ الْمُؤْمِنِ يَقْتُلُ الْمُؤْمِنَ مُتَعَمِّداً أَ لَهُ تَوْبَةٌ فَقَالَ إِنْ كَانَ قَتَلَهُ لِإِيمَانِهِ فَلَا تَوْبَةَ لَهُ وَ إِنْ كَانَ قَتَلَهُ لِغَضَبٍ أَوْ لِسَبَبِ شَيْءٍ مِنْ أَمْرِ الدُّنْيَا فَإِنَّ تَوْبَتَهُ أَنْ يُقَادَ مِنْهُ وَ إِنْ لَمْ يَكُنْ عُلِمَ بِهِ انْطَلَقَ إِلَى أَوْلِيَاءِ الْمَقْتُولِ فَأَقَرَّ عِنْدَهُمْ بِقَتْلِ صَاحِبِهِمْ فَإِنْ عَفَوْا عَنْهُ فَلَمْ يَقْتُلُوهُ أَعْطَاهُمُ الدِّيَةَ وَ أَعْتَقَ نَسَمَةً وَ صَامَ شَهْرَيْنِ مُتَتَابِعَيْنِ وَ أَطْعَمَ سِتِّينَ مِسْكِيناً تَوْبَةً إِلَى اللَّهِ عَزَّ وَ جَلَّ .

ہمارے بہت سے اصحاب نے سہل بن زیاد اور محمد بن یحییٰ سے، انہوں نے احمد بن محمد سے، سب نے مل کر ابن محبوب سے، انہوں نے عبد اللہ بن سنان اور ابن بکیر سے، انہوں نے ابو عبد اللہ علیہ السلام سے روایت کی کہ آپ نے فرمایا: آپ سے پوچھا گیا اس مومن کے بارے میں جو جان بوجھ کر کسی مومن کو قتل کر دے — کیا اس کے لیے توبہ ہے؟ تو آپ نے فرمایا: اگر اس نے اسے اس کے ایمان کی وجہ سے قتل کیا تو اس کے لیے کوئی توبہ نہیں۔ اور اگر اس نے اسے غصے کی وجہ سے یا دنیاوی معاملے کے سبب قتل کیا، تو اس کی توبہ یہ ہے کہ اس سے قصاص لیا جائے۔ اور اگر اس کے جرم کا پتہ نہ ہو تو مقتول کے ورثاء کے پاس جائے اور ان کے سامنے ان کے ساتھی کے قتل کا اعتراف کرے۔ پھر اگر وہ معاف کر دیں اور اسے قتل نہ کریں تو وہ انہیں دیت ادا کرے، ایک غلام آزاد کرے، دو مسلسل مہینے روزہ رکھے اور ساٹھ مساکین کو کھانا کھلائے — یہ اللہ عزوجل کی طرف توبہ ہے۔
Translation
A number of our companions, from Sahl Bin Ziyad and Muhammad Bin Yahya, from Ahmad Bin Muhammad, altogether from Ibn Mahboub from Abdullah Bin Sinan and Ibn Bakeyr, (It has been narrated) from Abu Abdullah<sup>asws</sup>, said, ‘He<sup>asws</sup> was asked about the Believer who kills the Believer deliberately, is there repentance for him? So he<sup>asws</sup> said: ‘If he killed him for his beliefs, so there is no repentance for him, and if had killed him due to anger, or for a reason for something from the affairs of the world, so his repentance is that he would be retaliated from it, and if he does not know of it, so he should go to the guardians of the killed one, so he confesses in their presence of the murder of their companions. So if they were to forgive from it, then he would not be killed, and he would give them the wergild, and emancipate a slave, and Fast for two moths consecutively, and feed sixty poor (people) as a repentance to Allah<sup>azwj</sup> Mighty and Majestic’.
