يُقَادُ بِهِ وَ إِنْ لَمْ يُعْلَمْ بِهِ انْطَلَقَ إِلَى أَوْلِيَائِهِ فَأَعْلَمَهُمْ أَنَّهُ قَتَلَهُ فَإِنْ عَفَوْا عَنْهُ أَعْطَاهُمُ الدِّيَةَ وَ أَعْتَقَ رَقَبَةً وَ صَامَ شَهْرَيْنِ مُتَتَابِعَيْنِ وَ تَصَدَّقَ عَلَى سِتِّينَ مِسْكِيناً .

ہمارے کئی اصحاب نے احمد بن محمد بن عیسیٰ سے، انہوں نے حسین بن سعید سے، انہوں نے نضر بن سوید سے، انہوں نے عبداللہ بن سنان سے، انہوں نے ابو عبداللہ علیہ السلام سے روایت کی کہ آپ سے پوچھا گیا اس شخص کے بارے میں جس نے ایک مومن کو قتل کیا جبکہ اسے معلوم تھا کہ وہ مومن ہے، مگر غصے نے اسے قتل پر اکسایا — کیا اس کے لیے توبہ ہے اگر وہ چاہے، یا اس کے لیے کوئی توبہ نہیں؟ آپ نے فرمایا: اس سے قصاص لیا جائے گا۔ اور اگر یہ معلوم نہ ہو تو وہ اس کے ولیوں کے پاس جائے اور انہیں بتائے کہ اس نے اسے قتل کیا ہے۔ اگر وہ اسے معاف کر دیں تو وہ انہیں دیت دے، ایک غلام آزاد کرے، دو ماہ مسلسل روزے رکھے اور ساٹھ مساکین کو صدقہ دے۔
Translation
A number of our companions, from Ahmad Bin Muhammad Bin Isa, from Al Husayn Bin Saeed, from Al Nazar Bin Suwed, from Abdullah Bin Sinan, (It has been narrated) from Abu Abdullah<sup>asws</sup> having been asked about a man who killed a Believer and he knew he was a Believer, besides that it was anger that carried him upon killing him. Is there repentance for him when he intends for that, or there is no repentance for him?’ So he<sup>asws</sup> said: ‘He would be retaliated with, and if he does not know, he should go to his (killed one’s) guardians, so he would let them know that he has killed him. So if they were to forgive him, he would give them the wergild, and emancipate a slave, and Fast for two months consecutively, and give charity upon sixty poor ones’.
