سَأَلْتُهُ عَنِ الْخَطَإِ الَّذِي فِيهِ الدِّيَةُ وَ الْكَفَّارَةُ أَ هُوَ أَنْ يَتَعَمَّدَ ضَرْبَ رَجُلٍ وَ لَا يَتَعَمَّدَ قَتْلَهُ قَالَ نَعَمْ قُلْتُ رَمَى شَاةً فَأَصَابَ إِنْسَاناً قَالَ ذَلِكَ الْخَطَأُ الَّذِي لَا شَكَّ فِيهِ عَلَيْهِ الدِّيَةُ وَ الْكَفَّارَةُ .

ہمارے کئی اصحاب نے سہل بن زیاد سے، انہوں نے احمد بن محمد بن ابی نصر سے، انہوں نے داود بن الحصین سے، انہوں نے ابوالعباس سے، انہوں نے ابو عبد اللہ علیہ السلام سے روایت کی۔ آپ نے فرمایا: میں نے آپ سے اس خطا کے بارے میں پوچھا جس میں دیت اور کفارہ ہے، کیا یہ وہ ہے کہ وہ کسی آدمی کو مارنے کا ارادہ کرے لیکن اسے قتل کرنے کا ارادہ نہ ہو؟ آپ نے فرمایا: ہاں۔ میں نے کہا: (کسی نے) بکری پر تیر چلایا اور کسی انسان کو لگ گیا؟ آپ نے فرمایا: یہ وہ خطا ہے جس میں کوئی شک نہیں — اس پر دیت اور کفارہ ہے۔
Translation
A number of our companions, from Sahl Bin Ziyad, from Ahmad Bin Muhammad Bin Abu Nasr, from Dawood Bin Al Husayn, from Abu Al Abbas, (The narrator) says, ‘I asked Abu Abdullah<sup>asws</sup> about the (killing in) error in which is the wergild and the expiation, is it he who intends to strike a man, but does not anticipate killing him?’ He<sup>asws</sup> said: ‘I said, ‘A sheep is fired (an arrow) at, so a human being is hit?’ He<sup>asws</sup> said: ‘That is the error in which there is no doubt, upon him would be the wergild and ‘الْكَفَّارَةُ’ the expiation’.
