رَجُلَيْنِ قَتَلَا رَجُلًا قَالَ إِنْ أَرَادَ أَوْلِيَاءُ الْمَقْتُولِ قَتْلَهُمَا أَدَّوْا دِيَةً كَامِلَةً وَ قَتَلُوهُمَا وَ تَكُونُ الدِّيَةُ بَيْنَ أَوْلِيَاءِ الْمَقْتُولَيْنِ فَإِنْ أَرَادُوا قَتْلَ أَحَدِهِمَا فَقَتَلُوهُ أَدَّى الْمَتْرُوكُ نِصْفَ الدِّيَةِ إِلَى أَهْلِ الْمَقْتُولِ وَ إِنْ لَمْ يُؤَدِّ دِيَةَ أَحَدِهِمَا وَ لَمْ يَقْتُلْ أَحَدَهُمَا قَبِلَ الدِّيَةَ صَاحِبُهُ مِنْ كِلَيْهِمَا .

علی بن ابراہیم نے محمد بن عیسیٰ سے، انہوں نے یونس سے، انہوں نے عبد اللہ بن مسکان سے، انہوں نے ابو عبد اللہ علیہ السلام سے، دو آدمیوں کے بارے میں جنہوں نے مل کر ایک آدمی کو قتل کیا۔ آپ نے فرمایا: اگر مقتول کے اولیاء ان دونوں کو قتل کرنا چاہیں تو وہ ایک مکمل دیت ادا کریں اور انہیں قتل کریں، اور دیت دونوں مقتولوں کے ورثاء کے درمیان تقسیم ہوگی۔ اگر وہ ان میں سے صرف ایک کو قتل کرنا چاہیں اور اسے قتل کریں، تو جو باقی رہ جائے وہ مقتول کے گھر والوں کو آدھی دیت ادا کرے۔ اگر وہ ان میں سے کسی ایک کی بھی دیت نہ لیں اور کسی کو قتل نہ کریں، تو مقتول کا ولی دونوں سے دیت قبول کر سکتا ہے۔
Translation
Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Abdullah Bin Muskan, (It has been narrated) from Abu Abdullah<sup>asws</sup> regarding two men who both killed one man. He<sup>asws</sup> said: ‘If the guardians of the killed one intend to kill both of them, or they have to pay the complete wergild (of one person), and kill them both, and the wergild would happen to be between the guardians of the two who are executed. So if they were to intend to execute one of the two, so they can kill him and the remaining one has to pay half the wergild to the family of the executed one; and if they do not want the payment of the wergild of one of the two and they do not kill any one of the two, the guardian of the killed (one) can accept the (half) wergild from each of the two’.
