قَضَى أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) فِي أَرْبَعَةٍ شَرِبُوا فَسَكِرُوا فَأَخَذَ بَعْضُهُمْ عَلَى بَعْضٍ السِّلَاحَ فَاقْتَتَلُوا فَقُتِلَ اثْنَانِ وَ جُرِحَ اثْنَانِ فَأَمَرَ بِالْمَجْرُوحَيْنِ فَضُرِبَ كُلُّ وَاحِدٍ مِنْهُمَا ثَمَانِينَ جَلْدَةً وَ قَضَى بِدِيَةِ الْمَقْتُولَيْنِ عَلَى الْمَجْرُوحَيْنِ وَ أَمَرَ أَنْ يُقَاسَ جِرَاحَةُ الْمَجْرُوحَيْنِ فَتُرْفَعَ مِنَ الدِّيَةِ فَإِنْ مَاتَ الْمَجْرُوحَانِ فَلَيْسَ عَلَى أَحَدٍ مِنْ أَوْلِيَاءِ الْمَقْتُولَيْنِ شَيْءٌ .

علی بن ابراہیم نے اپنے والد سے، اور محمد بن یحیی نے احمد بن محمد سے، دونوں نے مل کر ابن ابی نجران سے، انہوں نے عاصم بن حمید سے، انہوں نے محمد بن قیس سے، انہوں نے ابوجعفر علیہ السلام سے روایت کی کہ آپ نے فرمایا: امیر المومنین علیہ السلام نے چار ایسے افراد کے بارے میں فیصلہ کیا جنہوں نے (شراب) پی اور نشے میں آ گئے، پھر انہوں نے ایک دوسرے پر ہتھیار اٹھائے اور لڑے، تو دو قتل ہو گئے اور دو زخمی ہوئے۔ آپ علیہ السلام نے دونوں زخمیوں کو اسی اسی کوڑے مارنے کا حکم دیا، اور دو مقتولوں کی دیت کا فیصلہ دونوں زخمیوں پر کیا، اور حکم دیا کہ دونوں زخمیوں کے زخموں کا اندازہ لگا کر اسے دیت سے کم کیا جائے۔ اگر دونوں زخمی (بعد میں) مر جائیں تو دونوں مقتولوں کے اولیاء پر کچھ واجب نہیں۔
Translation
Ali Bin Ibrahim from his father, and Muhammad Bin Yahya from Ahmad Bin Muhammad, both together from Ibn Abu Najran, from Aasim Bin Humeyd, from Muhammad Bin Qays, (It has been narrated) from Abu Ja’far<sup>asws</sup> having said: ‘Amir Al-Momineen<sup>asws</sup> judged regarding four who had drunk (wine) so they were intoxicated. So they took weapons upon each other and fought. So two were killed and two were wounded. So he<sup>asws</sup> ordered for the two injured ones, so each one of them were whipped eighty lashes, and judged with regards to the wergild of the two killed ones to be upon the two injured ones, and ordered that surgery be performed on the injuries, so it was reimbursed from the wergild. So if the two injured ones died, so there would be nothing upon anyone from the guardians of the two killed ones’.
