John Shaqi

سَأَلْتُهُ عَنِ الرَّجُلِ يَحْفِرُ الْبِئْرَ فِي دَارِهِ أَوْ فِي أَرْضِهِ فَقَالَ أَمَّا مَا حَفَرَ فِي مِلْكِهِ فَلَيْسَ عَلَيْهِ ضَمَانٌ وَ أَمَّا مَا حَفَرَ فِي الطَّرِيقِ أَوْ فِي غَيْرِ مَا يَمْلِكُهُ فَهُوَ ضَامِنٌ لِمَا يَسْقُطُ فِيهِ .


Translation

A number of our companions, from Ahmad Bin Muhammad Bin Khalid, from Usman Bin Isa, from Sama’at who said, ‘I asked him<sup>asws</sup> about the man who dug the well in his own home, or in his own land. So he<sup>asws</sup> said: ‘As for what he dug in his kingdom, so there is no responsibility upon him, and as for what he digs in the road, or in other than what he owns, so he is responsible for whatever falls into it’.
