سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلام ) عَنْ رَجُلَيْنِ مِنْ أَصْحَابِنَا يَكُونُ بَيْنَهُمَا مُنَازَعَةٌ فِي دَيْنٍ أَوْ مِيرَاثٍ فَتَحَاكَمَا إِلَى السُّلْطَانِ أَوْ إِلَى الْقُضَاةِ أَ يَحِلُّ ذَلِكَ فَقَالَ مَنْ تَحَاكَمَ إِلَى الطَّاغُوتِ فَحَكَمَ لَهُ فَإِنَّمَا يَأْخُذُ سُحْتاً وَ إِنْ كَانَ حَقُّهُ ثَابِتاً لِأَنَّهُ أَخَذَ بِحُكْمِ الطَّاغُوتِ وَ قَدْ أَمَرَ اللَّهُ أَنْ يُكْفَرَ بِهِ قُلْتُ كَيْفَ يَصْنَعَانِ قَالَ انْظُرُوا إِلَى مَنْ كَانَ مِنْكُمْ قَدْ رَوَى حَدِيثَنَا وَ نَظَرَ فِي حَلَالِنَا وَ حَرَامِنَا وَ عَرَفَ أَحْكَامَنَا فَارْضَوْا بِهِ حَكَماً فَإِنِّي قَدْ جَعَلْتُهُ عَلَيْكُمْ حَاكِماً فَإِذَا حَكَمَ بِحُكْمِنَا فَلَمْ يَقْبَلْهُ مِنْهُ فَإِنَّمَا بِحُكْمِ اللَّهِ قَدِ اسْتَخَفَّ وَ عَلَيْنَا رَدَّ وَ الرَّادُّ عَلَيْنَا الرَّادُّ عَلَى اللَّهِ وَ هُوَ عَلَى حَدِّ الشِّرْكِ بِاللَّهِ .

محمد بن یحییٰ نے محمد بن الحسین سے، انہوں نے محمد بن عیسیٰ سے، انہوں نے صفوان سے، انہوں نے داود بن الحصین سے، انہوں نے عمر بن حنظلہ سے روایت کی کہ انہوں نے کہا: میں نے ابو عبد اللہ علیہ السلام سے اپنے دو اصحاب کے بارے میں پوچھا جن کے درمیان قرض یا میراث کے بارے میں جھگڑا تھا اور وہ دونوں فیصلے کے لیے سلطان یا قاضیوں کے پاس گئے۔ کیا یہ جائز ہے؟ تو آپ نے فرمایا: جو شخص طاغوت کے پاس فیصلے کے لیے جائے اور وہ اس کے حق میں فیصلہ کرے، تو اس نے صرف سحت (حرام مال) لیا، چاہے اس کا حق ثابت ہو، کیونکہ اس نے طاغوت کے حکم سے لیا، اور اللہ نے حکم دیا ہے کہ اس کا انکار کیا جائے۔ میں نے عرض کیا: وہ دونوں کیا کریں؟ آپ نے فرمایا: اپنے درمیان سے اس شخص کو تلاش کرو جس نے ہماری احادیث روایت کی ہوں، ہمارے حلال و حرام میں غور کیا ہو اور ہمارے احکام کو جانتا ہو۔ اسے حَکَم (منصف) کے طور پر قبول کرو، کیونکہ میں نے اسے تم پر حاکم مقرر کیا ہے۔ پس جب وہ ہمارے حکم کے مطابق فیصلہ کرے اور اسے قبول نہ کیا جائے، تو بے شک اللہ کے حکم کو ہلکا سمجھا گیا اور ہمارا رد کیا گیا۔ اور جو ہمیں رد کرتا ہے وہ اللہ کو رد کرتا ہے، اور وہ اللہ کے ساتھ شرک کی حد پر ہے۔
Translation
Muhammad Bin Yahya, from Muhammad Bin Al Husayn, from Muhammad Bin Isa, from Safwan, from Dawood Bin Al Husayn, from Umar Bin Hanzala who said, ‘I asked Abu Abdullah<sup>asws</sup> about two men from our companions who happened to have a dispute between them regarding a debt, or inheritance. So they went to the Sultan (ruling authority) for judgement, or to the judge. Is that permissible?’ So he<sup>asws</sup> said: ‘The one who goes for a judgement to the tyrant, so he judges for him, so he has rather taken ill-gotten gains, even if it was his right, proved, because he has taken it by a judgement of the tyrant. And Allah<sup>azwj</sup> has Commanded that <span class="ibTxt"><a href="/#/books/quran:4#h60"><a href="/books/quran:4#h60">[4:60]</a></a> though they were Commanded to deny him</span>’. I said, ‘How should they both deal with it?’ He<sup>asws</sup> said: ‘They should look around to the one who was among them who has reported our<sup>asws</sup> Hadeeth, and has looked into our<sup>asws</sup> Permissibles, and our<sup>asws</sup> Prohibition, and recognises our<sup>asws</sup> judgements. So they should present to him for the judgement, for I<sup>asws</sup> have made him to be a judge over you. So when he judges by our<sup>asws</sup> judgements, and it is not accepted from him, so rather it is the Judgement of Allah<sup>azwj</sup> which has been taken lightly, and against us<sup>asws</sup> is the rejection, and the rejection against us<sup>asws</sup> is the rejection against Allah<sup>azwj</sup>, and he (the rejecter) would be upon a legal penalty (<span class="iTxt">Hadd</span>) of the association with Allah<sup>azwj</sup>’.
