سَأَلْتُ أَبَا الْحَسَنِ ( عليه السلام ) هَلْ لِلرَّجُلِ أَنْ يَتَمَتَّعَ مِنَ الْمَمْلُوكَةِ بِإِذْنِ أَهْلِهَا وَ لَهُ امْرَأَةٌ حُرَّةٌ قَالَ نَعَمْ إِذَا رَضِيَتِ الْحُرَّةُ قُلْتُ فَإِنْ أَذِنَتِ الْحُرَّةُ يَتَمَتَّعُ مِنْهَا قَالَ نَعَمْ . وَ رُوِيَ أَيْضاً أَنَّهُ لَا يَجُوزُ أَنْ يُتَمَتَّعَ بِالْأَمَةِ عَلَى الْحُرَّةِ .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad Bin Isa, from Muhammad Bin Ismail who said, ‘I asked Abu Al-Hassan<sup>asw</sup><sup>s</sup>, ‘Is it for the man that he marries by <span class="iTxt">Mut’a</span> to the slave girl with the permission of her owner, and for him there is (already) a free woman (as a wife)?’ He<sup>asws</sup> said: ‘Yes, when the free woman agrees’. I said, ‘Supposing the free woman (wife) were to allow, can he marry by <span class="iTxt">Mut’a</span> from them?’ He<sup>asws</sup> said: ‘Yes’. And it is reported as well that he<sup>asws</sup> did not allow that he one should marry with the slave girl (as an additional wife) upon the free woman’.
