الْحَسَن بْن مَحْبُوب نے سَعْد بْن أَبِي خَلَف الزَّامّ سے، وہ سِنَان بْن طَرِيف سے، وہ أَبُو عَبْدِ اللّٰہ علیہ السلام سے روایت کرتے ہیں، جنہوں نے فرمایا: ایک شخص کے بارے میں پوچھا گیا جس کی تین بیویاں تھیں، پھر اس نے ایک اور عورت سے نکاح کیا لیکن اس کے ساتھ مباشرت نہیں کی۔ پھر وہ ایک کنیزہ کو آزاد کرنا چاہتا تھا اور اس سے نکاح کرنا چاہتا تھا۔ تو اس نے کہا: اگر وہ اس عورت کو طلاق دے جس کے ساتھ اس نے مباشرت نہیں کی تو اس کے لیے اسی دن دوسری عورت سے نکاح کرنا جائز ہے۔ لیکن اگر وہ ان تین بیویوں میں سے کسی ایک کو طلاق دے جس کے ساتھ اس نے مباشرت کی ہو تو اس کے لیے جائز نہیں کہ وہ دوسری عورت سے نکاح کرے جب تک طلاق شدہ عورت کی عدت پوری نہ ہو جائے۔

Translation

Hadith.4462 - Al-Hasan ibn Mahbub narrated from Sa'd ibn Abi Khalaf al-Zam and Sinan ibn Tarif, who narrated from Abu Abdullah (as): Imam (as) was asked about a man who had three wives, then married another woman but did not consummate the marriage with her. Later, he wanted to emancipate a bondwoman and marry her. Imam (as) said: "If he divorces the woman with whom he had not consummated the marriage, then there is no harm in him marrying another woman on that same day. However, if he divorces one of the three wives with whom he had consummated the marriage, he cannot marry another woman until the waiting period of the divorced wife is completed."
