اور یہ روایت ہے طریف بن سنان الثوری سے، جنہوں نے کہا: میں نے جعفر بن محمد علیہ السلام سے ایک ایسے شخص کے بارے میں پوچھا جس نے ایک آزاد عورت کو چوری کیا اور اسے بیچ دیا، تو انہوں نے فرمایا: اس میں چار قانونی حدود ہیں۔ پہلی یہ کہ وہ چور ہے، اس کا ہاتھ کاٹ دیا جائے۔ دوسری یہ کہ اگر اس نے اس کے ساتھ مباشرت کی تو اسے حد کی سزا دی جائے۔ اور جس نے اسے خریدا، اگر اس نے جانتے ہوئے اس کے ساتھ مباشرت کی، تو اگر وہ محصن تھا تو اسے رجم کیا جائے، اور اگر محصن نہ تھا تو اسے حد کی سزا دی جائے۔ اور اگر اسے معلوم نہ تھا تو نہ اس پر کچھ ہے اور نہ اس پر۔ اور اگر اس نے اسے زبردستی کیا تو اس پر کچھ نہیں۔ اور اگر وہ اس کی رضا سے تھی تو اسے حد کی سزا دی جائے۔

Translation

Hadith.5126 - It was narrated from Tarif ibn Sinan Al-Thawri who said: I asked Imam Jafar ibn Muhammad Al-Sadiq (as) about a man who stole a free woman and sold her. Imam (as) said: "There are four legal punishments in this case. The first is that since he stole, his hand is to be cut off. The second is that if he had intercourse with her, he is to be flogged with the legal punishment. The third is upon the one who bought her: if he had intercourse with her and knew her status, then if he was married (muhsan), he is to be stoned, and if he was unmarried (non-muhsan), he is to be flogged with the legal punishment. However, if he did not know (her status), then there is nothing upon him or upon her. The fourth is that if she was forced into it, there is no punishment upon her, but if she consented, she is to be flogged with the legal punishment."
