5228 - وَ رَوَى إِسْمَاعِيلُ بْنُ أَبِي زِيَادٍ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ "أَنَّ مُحَمَّدَ بْنَ أَبِي بَكْرٍ رَضِيَ اَللَّهُ عَنْهُ كَتَبَ إِلَى أَمِيرِ اَلْمُؤْمِنِينَ عَلَيْهِ اَلسَّلاَمُ : يَسْأَلُهُ عَنْ رَجُلٍ مَجْنُونٍ قَتَلَ رَجُلاً عَمْداً فَجَعَلَ عَلَيْهِ اَلسَّلاَمُ اَلدِّيَةَ عَلَى قَوْمِهِ وَ جَعَلَ خَطَأَهُ وَ عَمْدَهُ سَوَاءً".
اردو
اور اسماعیل ابن ابی زیاد نے ابو عبداللہ علیہ السلام سے روایت کی۔ کہ محمد ابن ابی بکر رضی اللہ عنہ نے امیرالمؤمنین علیہ السلام کو ایک پاگل شخص کے بارے میں لکھا جو جان بوجھ کر کسی کو قتل کر بیٹھا۔ تو آپ علیہ السلام نے اس کی دیہ اپنی قوم پر مقرر کی اور اس کے غلطی اور عمدہ دونوں کو برابر سمجھا۔
Translation
Hadith.5228 - Ismaʿil ibn Abi Ziyad narrated from Abu Abdullah (as) that Muhammad ibn Abi Bakr (may Allah (swt) be pleased with him) wrote to the Commander of the Faithful (as) asking about a mentally ill man who intentionally killed another man. The Commander of the Faithful (as) ruled that the blood money (diyyah) was upon his tribe (Aqilah) and that both his accidental and intentional acts were to be treated the same.
