نَصْرَانِيٍّ قَتَلَ مُسْلِماً فَلَمَّا أُخِذَ أَسْلَمَ أَقْتُلُهُ بِهِ قَالَ "نَعَمْ" قِيلَ فَإِنْ لَمْ يُسْلِمْ قَالَ "يُدْفَعُ إِلَى أَوْلِيَاءِ اَلْمَقْتُولِ فَإِنْ شَاءُوا قَتَلُوا وَ إِنْ شَاءُوا عَفَوْا وَ إِنْ شَاءُوا اِسْتَرَقُّوا وَ إِنْ كَانَ مَعَهُ مَالٌ عَيْنٌ لَهُ دُفِعَ إِلَى أَوْلِيَاءِ اَلْمَقْتُولِ هُوَ وَ مَالُهُ".

5251 - الحسن ابن محبوب نے علی ابن ریاب سے روایت کی، دریس الكنّاسی سے، ابو جعفر علیہ السلام سے: ایک نصرانی نے ایک مسلمان کو قتل کیا، پھر جب اسے گرفتار کیا گیا تو اس نے اسلام قبول کر لیا: 'کیا میں اسے اس کے لیے قتل کروں؟' انہوں نے کہا: 'ہاں۔' کہا گیا: 'اگر وہ اسلام قبول نہ کرے؟' انہوں نے کہا: 'وہ مقتول کے وارثوں کے حوالے کر دیا جاتا ہے؛ اگر وہ چاہیں تو اسے قتل کر دیں؛ اگر چاہیں تو معاف کر دیں؛ اور اگر چاہیں تو غلام بنا لیں۔ اور اگر اس کے پاس کوئی مخصوص مال ہو جو اس کا ہو، تو وہ بھی مقتول کے وارثوں کو دے دیا جاتا ہے—وہ اور اس کا مال۔'
Translation
Hadith.5251 - Al-Hasan ibn Mahbub narrated from Ali ibn Riʾab from Ḍurays Al-Kunasi who reported from Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) regarding a Christian man who killed a Muslim. When he was captured, he accepted Islam. Imam (as) was asked: "Should he be killed for the Muslim he murdered?" Imam (as) replied: "Yes." It was then asked: "And if he does not accept Islam?" Imam (as) said: "He will be handed over to the heirs of the murdered person. If they wish, they may kill him, if they wish, they may pardon him, and if they wish, they may enslave him. And if he possesses any tangible wealth, it will be handed over to the heirs of the murdered person along with him."
