اور عاصم بن حمید نے محمد بن قیص سے روایت کی، جو ابو جعفر الباقر علیہ السلام سے روایت کرتے ہیں، جنہوں نے فرمایا: امیرالمؤمنین علیہ السلام نے ایک شخص کے بارے میں فیصلہ دیا جس نے دوسرے کو وصیت کی جبکہ جس کے لیے وصیت کی گئی وہ غائب تھا، اور پھر جس کے لیے وصیت کی گئی وہ وصیت کنندہ سے پہلے فوت ہو گیا۔ انہوں نے فرمایا: "وصیت اس وارث کی ہے جس کے لیے وصیت کی گئی تھی۔" اور انہوں نے فرمایا: "جو کوئی کسی کو وصیت کرے، چاہے وہ حاضر ہو یا غائب، اور وصیت کا مستفید وصیت کنندہ سے پہلے فوت ہو جائے، تو وصیت اس وارث کی ہے جس کے لیے وصیت کی گئی، جب تک کہ وصیت کنندہ اپنی وصیت اپنی موت سے پہلے واپس نہ لے۔"

Translation

Hadith.5489 - Asim ibn Humaid narrated from Muhammad ibn Qays from Abu Ja'far Imam Muhammad ibn Ali Al-Baqir (as) who said: "Commander of the Faithful (as) ruled concerning a man who made a bequest to another, but the person to whom the bequest was made was absent and died before the one who made the bequest. Imam (as) said: 'The bequest is for the heir of the one to whom it was made.' Imam (as) also said: 'Whoever makes a bequest to someone, whether present or absent, and the beneficiary dies before the one who made the bequest, then the bequest goes to the heir of the beneficiary, unless the testator revokes the bequest before his own death.'"
