John Shaqi

: سَأَلْتُهُ عَنِ اَلسُّكْنَى وَ اَلْعُمْرَى فَقَالَ "اَلنَّاسُ فِيهِ عِنْدَ شُرُوطِهِمْ إِنْ كَانَ شَرَطَ حَيَاتَهُ فَهُوَ حَيَاتَهُ وَ إِنْ كَانَ لِعَقِبِهِ فَهُوَ لِعَقِبِهِ كَمَا شَرَطَ حَتَّى يَفْنَوْا ثُمَّ تُرَدُّ إِلَى صَاحِبِ اَلدَّارِ".


اردو

محمد ابن ابی عمیر نے ابان ابن عثمان سے، انہوں نے عبد الرحمن ابن ابی عبداللہ سے، انہوں نے حمْران سے روایت کی، جنہوں نے کہا: میں نے ان سے السکنى اور العمرى کے بارے میں پوچھا۔ انہوں نے کہا: "لوگ اس معاملے میں اپنی شرائط کے پابند ہوتے ہیں۔ اگر اس نے اپنی زندگی کے لیے شرط رکھی تو یہ اس کی زندگی کے لیے ہے۔ اور اگر یہ اس کی اولاد کے لیے تھی تو یہ ان کی اولاد کے لیے ہے جیسا کہ شرط رکھی گئی ہے یہاں تک کہ وہ فنا ہو جائیں؛ پھر یہ مکان کے مالک کو واپس کر دی جاتی ہے۔"


Translation

Hadith.5598 - Muhammad ibn Abi Umayr narrated from Aban ibn Uthman from Abdur Rahman ibn Abi Abdullah from Humran who said: I asked Imam (as) about Al-sukna (residential right) and Al-umra (life estate). Imam (as) replied: "People are bound by their conditions. If he stipulated it for his lifetime, then it is for his lifetime. If he stipulated it for his descendants, then it is for his descendants as stipulated until they perish, after which it returns to the owner of the house."
