اور حَمّاد ابن عیسی نے الحُسین ابن المختار سے روایت کی، جنہوں نے کہا: ابو حنیفہ نے ابو عبداللہ علیہ السلام کے پاس داخل ہوئے، اور ابو عبداللہ علیہ السلام نے ان سے کہا: "تم اس گھر کے بارے میں کیا کہتے ہو جو لوگوں پر گر گیا، اور ان میں سے دو لڑکے بچے بچ گئے، جن میں سے ایک آزاد تھا اور دوسرا اپنے مالک کا غلام، لیکن یہ معلوم نہ ہو سکا کہ کون آزاد ہے اور کون غلام؟" ابو حنیفہ نے کہا: "ان دونوں میں سے آدھا آدھا آزاد کیا جائے اور مال دونوں میں برابر تقسیم کیا جائے۔" پھر ابو عبداللہ علیہ السلام نے فرمایا: "ایسا نہیں ہے، بلکہ قرعہ اندازی کی جائے گی، جس پر قرعہ پڑے گا وہ آزاد ہوگا، اور دوسرے کو آزاد کر کے اس کا مولا بنایا جائے گا۔"

Translation

Hadith.5660 - Hammad ibn Isa narrated from Al-Husayn ibn Al-Mukhtar, who said: Abu Hanifah entered upon Abu Abdullah (as), and Abu Abdullah (as) asked him: "What do you say about a house that collapsed on a group of people, leaving behind two boys - one of them is free and the other is a slave belonging to the free one - but it is not known which is the free one and which is the slave?" Abu Hanifah replied: "Half of this one and half of that one should be freed, and the wealth should be divided equally between them." Abu Abdullah (as) said: "It is not so. Rather, a draw (lot) should be cast between them, and the one upon whom the lot falls is the free one, and the other is freed and made his client (mawla)."
