ابن ابی نصر نے حمّاد سے، جو اسحاق بن عمار سے روایت کرتے ہیں، بیان کیا: میں نے اس سے ایک ایسے شخص کے بارے میں پوچھا جو فوت ہو گیا اور بچے چھوڑ گیا، جبکہ ان میں سے کچھ غائب تھے اور معلوم نہیں تھا کہ وہ کہاں ہے۔ اس نے کہا: "اس کی میراث تقسیم کی جائے گی، اور غائب کا حصہ الگ رکھا جائے گا۔" میں نے کہا: "کیا اس پر زکات واجب ہے؟" اس نے کہا: "نہیں، جب تک وہ واپس نہ آئے، اسے قبضہ نہ کرے، اور اس پر ایک سال نہ گزر جائے۔" میں نے کہا: "اگر معلوم نہ ہو کہ وہ کہاں ہے؟" اس نے کہا: "اگر وارث مالدار ہوں تو وہ اس کی میراث تقسیم کر سکتے ہیں؛ پھر اگر وہ آئے تو اسے واپس کر دیں۔"

Translation

Hadith.5709 - Ibn Abi Nasr narrated from Hammad from Ishaq ibn Ammar who said: I asked Imam (as) about a man who died and left behind children, some of whom were absent and their whereabouts were unknown. Imam (as) said: "Inheritance should be divided, and the share of the absent one will be set aside." I asked: "Is zakat due on it?" Imam (as) said: "No, not until he returns, takes possession of it, and a full year passes over it." I asked: "What if his whereabouts are completely unknown?" Imam (as) said: "If the remaining heirs are financially well-off, they may divide the inheritance. If he returns, they must restore his share to him."
