رَجُلٍ مُسْلِمٍ قُتِلَ وَ لَهُ أَبٌ نَصْرَانِيٌّ لِمَنْ تَكُونُ دِيَتُهُ قَالَ "تُؤْخَذُ فَتُجْعَلُ فِي بَيْتِ مَالِ اَلْمُسْلِمِينَ لِأَنَّ جِنَايَتَهُ عَلَى بَيْتِ مَالِ اَلْمُسْلِمِينَ ".

الْحَسَن بْن مَحْبُوب نے مَالِک بْن عَطِیَّہ سے روایت کی، جو سُلَیْمَان بْن خَالِد سے، جو أَبُو عَبْدِ اللّٰہ علیہ السلام سے روایت کرتے ہیں: ایک مسلمان شخص کے بارے میں جو قتل ہو گیا اور اس کا والد نصرانی تھا: اس کی دیہ کس کے حق میں ہوگی؟ انہوں نے علیہ السلام فرمایا: "یہ لیا جاتا ہے اور مسلمانوں کے بیت المال میں رکھا جاتا ہے، کیونکہ اس کی ذمہ داری مسلمانوں کے بیت المال پر ہے۔"
Translation
Hadith.5716 - Al-Hasan ibn Mahbub narrated from Malik ibn Atiyyah from Sulayman ibn Khalid from Abu Abdullah (as) regarding a Muslim man who was killed and had a Christian father. Imam (as) was asked: "To whom does his blood money (diyyah) go?" Imam (as) said: "It is taken and placed in the treasury (Bayt Al-Mal) of the Muslims because his liability falls upon the treasury of the Muslims."
